These Terms and Conditions apply to purchases made from South East Frags through our website at https://southeastfrags.com.au.

South East Frags is an Australian online aquarium store selling aquarium-related products, including coral frags, live aquarium items, reef gear, equipment, accessories and dry goods.

By using our website or placing an order with us, you agree to these Terms and Conditions, together with our Privacy Policy, Shipping and Livestock Delivery Policy, and DOA Guarantee, Refund, and Returns Policy.

Nothing in these Terms and Conditions limits or excludes any rights you may have under the Australian Consumer Law.

1. About South East Frags

South East Frags operates as an online aquarium store. Our products may include coral frags, livestock, reef aquarium products, dry goods, equipment, accessories and related items.

2. Use of our website

You agree to use our website only for lawful purposes and in a way that does not interfere with the operation, security or availability of the website.

You must not misuse the website, attempt to gain unauthorised access to any part of the website, interfere with checkout or payment systems, submit false information, or use the website in a way that may damage South East Frags, our customers, our systems or third-party service providers.

3. Product information and availability

We aim to keep product descriptions, images, pricing and availability information as accurate and up to date as reasonably possible. However, errors may occasionally occur.

Product availability may change without notice. Some items, especially livestock and coral frags, may be limited in quantity or one-off pieces.

We may refuse, cancel or refund an order if a product is unavailable, incorrectly listed, incorrectly priced, unsuitable for shipping, or unable to be supplied for any other reasonable reason.

4. Coral, livestock and natural variation

Corals and other live aquarium items are natural living organisms. Colour, shape, size, polyp extension, growth form and appearance may vary depending on lighting, water parameters, stress, transport, acclimation and the customer’s aquarium environment.

Photos are provided to help identify the product being sold. Where a product is described as WYSIWYG, the product shown is intended to represent the specific item being sold unless otherwise stated. However, coral appearance may still vary under different lighting, camera settings and aquarium conditions.

For non-WYSIWYG items, images may be representative examples only. The actual item supplied may vary from the image due to natural variation.

5. Customer responsibility for aquarium suitability

Before purchasing livestock, coral or aquarium products, you are responsible for considering whether the item is suitable for your aquarium, equipment, water parameters, experience level and existing livestock.

Care information provided on our website is general guidance only. It does not guarantee that a coral, livestock item or aquarium product will perform in a particular way in your aquarium.

Livestock health and coral survival after delivery or pickup can be affected by many factors outside our control, including aquarium maturity, salinity, alkalinity, calcium, magnesium, nutrients, temperature, lighting, flow, acclimation, pests, aggression from other livestock, handling and general husbandry.

6. Orders and order acceptance

When you place an order through our website, you are making an offer to purchase the selected products. An order confirmation email confirms that we have received your order, but it does not guarantee that the order has been accepted, dispatched or completed.

We may contact you before processing or dispatching an order if we need to confirm product availability, payment, shipping suitability, address details, pickup arrangements, or any other order information.

We may cancel and refund an order before dispatch if we reasonably determine that the order cannot be supplied, should not be shipped, contains an error, appears fraudulent, or cannot be fulfilled safely or properly.

7. Pricing and payment

Prices are shown in Australian dollars unless otherwise stated.

We may update prices, promotions and product availability at any time without notice. The price payable for an order is the price shown at checkout at the time the order is placed, subject to correction of obvious errors.

Available payment methods may include online payment options, PayPal, PayID, bank transfer or other payment methods shown at checkout.

For PayID or bank transfer payments, your order will generally be processed once payment has cleared and has been matched to your order. Delayed or incomplete payment may delay processing or dispatch.

If a payment discount, promotion or special offer is available, it will apply only in accordance with the terms shown on the website or at checkout. Discounts may not apply to all products, shipping charges, quote-required items or manually adjusted orders unless stated.

8. Shipping and delivery

Shipping and delivery are handled in accordance with our Shipping and Livestock Delivery Policy.

Livestock and coral orders are sensitive and time-critical. We may delay dispatch if we consider shipping conditions unsuitable, including severe weather, heat, cold, public holiday congestion, courier network congestion, delivery delays, or locations where overnight service is not available or reliable.

Livestock and coral shipments may be sent using Authority to Leave where stated in our Shipping and Livestock Delivery Policy. By placing a livestock or coral shipping order, you acknowledge that courier handling, delivery timing, weather and location conditions may affect livestock shipments.

Please ensure your delivery address is accurate, suitable for delivery, and not a PO box. We do not ship livestock, coral or dry goods orders to PO boxes.

9. Local pickup

Local pickup is available by appointment only where offered.

After your order is placed, we will contact you to arrange a suitable pickup time. Please do not attend for pickup until an appointment has been confirmed.

For livestock and coral pickup orders, please inspect the item at pickup where possible. If you have any concerns, please raise them before taking the item home.

Once livestock or coral has been collected and accepted, change-of-mind returns are not accepted.

10. DOA guarantee, refunds and returns

DOA claims, refunds and returns are handled in accordance with our DOA Guarantee, Refund, and Returns Policy.

Due to the sensitive and perishable nature of livestock and corals, we do not accept change-of-mind returns for livestock, coral frags, live coral or other live aquarium items.

For shipped corals covered by our DOA guarantee, you must contact us on the same day as delivery and provide the information requested in our DOA Guarantee, Refund, and Returns Policy. This may include your order number, clear photos of the coral, photos of the unopened bag or container where possible, relevant delivery information, and a brief description of the issue.

DOA claims are assessed based on the information provided, the delivery record, weather conditions, courier delays, and the condition of the item on arrival.

If a DOA claim is approved, we may offer a replacement, store credit or refund for the affected item, depending on the circumstances and availability. Original shipping costs may be excluded where permitted by law.

Dry goods returns, faulty goods, damaged goods and incorrect items are handled in accordance with our DOA Guarantee, Refund, and Returns Policy and your rights under the Australian Consumer Law.

11. Bulk, oversized and quote-required items

Some products may be marked as bulk items, oversized items or shipping quote required.

If your order contains a bulk, oversized or quote-required item, automatic shipping calculation may not apply. We may contact you after order review to confirm the shipping cost or available delivery options.

If the final shipping cost or delivery option is not suitable, we may cancel and refund the order before dispatch.

12. Order changes and cancellations

If you need to change or cancel an order, please contact us as soon as possible.

We will try to assist where practical, but we may not be able to change or cancel an order once it has been packed, booked for courier collection, dispatched, prepared for pickup, or otherwise processed.

For livestock and coral orders, cancellations may not be available once the item has been packed, held, allocated, prepared for dispatch, or otherwise made unavailable for sale to other customers.

13. Customer accounts

You may be able to create a customer account on our website.

You are responsible for keeping your login details secure and for any activity that occurs under your account. Please contact us promptly if you believe your account has been accessed without permission.

We may suspend or restrict an account if we reasonably believe it has been misused, compromised, used fraudulently, or used in breach of these Terms and Conditions.

14. Reviews, comments and user-submitted content

If product reviews, comments or other user-submitted content features are enabled, you must not submit content that is false, misleading, offensive, unlawful, defamatory, spam, promotional without permission, or infringes another person’s rights.

We may moderate, remove or refuse to publish user-submitted content at our discretion.

By submitting content to our website, you grant us permission to display, reproduce and use that content for website, store and promotional purposes, unless otherwise agreed.

15. Website content and intellectual property

Unless otherwise stated, website content including text, product descriptions, images, graphics, layout, branding and other materials are owned by South East Frags or used with permission.

You must not copy, reproduce, republish, modify, distribute or commercially use our website content without our prior written permission, except as permitted by law.

18. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a replacement, refund, repair or other remedy if a product does not meet a consumer guarantee, including where a product has a major problem, is faulty, unsafe, significantly different from its description, or otherwise fails to meet applicable consumer guarantees.

These Terms and Conditions, together with our store policies, are intended to explain how we operate our online store. They do not limit or exclude any rights you may have under Australian law.

19. Limitation of liability

To the maximum extent permitted by law, South East Frags is not liable for loss, damage, cost or expense arising from matters outside our reasonable control, including courier delays, weather events, delivery network congestion, incorrect customer information, unsuitable aquarium conditions, improper acclimation, misuse of products, unauthorised product modification, or failure to follow product instructions or care guidance.

Where liability cannot be excluded under the Australian Consumer Law or other applicable law, our liability is limited only to the extent permitted by law.

20. Events outside our reasonable control

We are not responsible for delays or failure to perform an obligation where the delay or failure is caused by events outside our reasonable control.

This may include severe weather, heat, cold, courier delays, courier network congestion, public holidays, supply shortages, website outages, payment processing issues, freight disruptions, power outages, natural disasters, biosecurity issues, government restrictions or other events beyond our reasonable control.

We may update these Terms and Conditions from time to time.

The latest version will be published on this page with the updated date. By continuing to use our website or placing an order after the Terms and Conditions are updated, you agree to the updated version.

22. Governing law

These Terms and Conditions are governed by the laws of Victoria, Australia.

Any dispute relating to these Terms and Conditions, our website or purchases from South East Frags will be handled in accordance with the laws of Victoria, Australia, subject to any rights you may have under Australian Consumer Law or other applicable legislation.
